1. Agreement to Terms

By downloading, installing, accessing, or using Kauf! ("the Application" or "the App"), you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing the Application.

2. Description of Service

Kauf! is a shared shopping list application designed to help users create, manage, and share shopping lists with family members, roommates, or partners. The Application:

• Allows users to create and manage shopping lists
• Enables real-time synchronization between multiple devices
• Works offline and syncs when connection is restored
• Supports anonymous accounts for privacy
• Offers premium features to support development and remove advertisements

3. Subscription Services (Premium)

3.1 Premium Features

Kauf! offers a premium subscription that includes:

• Ad-free experience
• Priority support
• Enhanced synchronization features
• Additional customization options

3.2 Subscription Plans

Kauf! may offer the following subscription plans (if applicable):

• Monthly Subscription: Pricing to be determined
• Annual Subscription: Pricing to be determined

3.3 Auto-Renewal

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current subscription period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscriptions through your account settings or the app store where you purchased the subscription

3.4 Cancellation

• You may cancel your subscription at any time through your account settings
• Cancellation will take effect at the end of the current subscription period
• You will continue to have access to premium features until the end of the current subscription period
• No refunds will be provided for the current subscription period unless required by law

3.5 Price Changes

• We reserve the right to change subscription prices at any time
• Price changes will not affect your current subscription period
• You will be notified of price changes before your next renewal period

3.6 Refunds

• Refunds are handled according to the app store's refund policy (Apple App Store or Google Play Store)
• You may request a refund through the standard refund process of the app store
• Refund eligibility is determined by the app store, not by Kauf!

4. License Grant and Restrictions

4.1 License

Subject to your compliance with these Terms of Use, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the Application on your personal mobile device
• Use the Application for your personal, non-commercial use
• Access and use the features and services provided through the Application

4.2 Restrictions

You agree NOT to:

• Copy, modify, or create derivative works of the Application
• Reverse engineer, decompile, or disassemble the Application
• Remove, alter, or obscure any proprietary notices or labels
• Use the Application for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any part of the Application
• Use the Application in any way that could damage, disable, or impair the Application
• Share your account credentials with unauthorized parties

5. User Responsibilities

5.1 Account Security

• You are responsible for maintaining the confidentiality of your device and any authentication methods
• You are responsible for all activities that occur under your account
• You must immediately notify us of any unauthorized use of your account
• Anonymous accounts are designed for privacy but you are still responsible for their security

5.2 Data Accuracy

• You are responsible for the accuracy of data you enter into the Application
• The Application is a tool to help you manage shopping lists, but you are responsible for verifying the accuracy of information
• You are responsible for keeping your lists updated and relevant

5.3 Acceptable Use

• You agree to use the Application in accordance with all applicable laws and regulations
• You agree not to use the Application in any way that violates the rights of others
• You agree not to use the Application to transmit any harmful, offensive, or malicious content
• You agree not to use the Application to spam or harass other users
• You agree to respect the privacy of other users when sharing lists

5.4 Shared Lists

• When you share a list with others, you grant them access to view and modify that list
• You are responsible for the content of lists you create and share
• You should only share lists with people you trust
• You can remove access to shared lists at any time

6. Privacy and Data Protection

6.1 Privacy Policy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

6.2 Data Storage

• Data is stored locally on your device
• When you share lists, data is synchronized between authorized devices
• We use encryption to protect data during synchronization
• Anonymous accounts provide additional privacy protection

6.3 Offline Functionality

• The Application works offline and stores data locally
• When you regain internet connection, data is synchronized automatically
• You are responsible for ensuring your device has adequate storage space

6.4 Data Export and Deletion

• You can export your lists at any time through the Application's export features (if available)
• You can delete your lists and account data at any time through the Application's settings
• Deletion is permanent and cannot be undone
• When you delete a shared list, it will be removed for all participants

7. Intellectual Property Rights

7.1 Ownership

• The Application, including all content, features, and functionality, is owned by Kauf! and is protected by international copyright, trademark, and other intellectual property laws
• All trademarks, service marks, and trade names are the property of their respective owners

7.2 User Content

• You retain ownership of any content (lists, items, notes) you create in the Application
• By using the Application, you grant us a limited license to use your content solely for the purpose of providing the Application's services (storage, synchronization, etc.)
• We do not claim ownership of your personal lists or data
• You are responsible for ensuring you have the right to share any content you add to shared lists

8. Limitation of Liability

8.1 Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY, RELIABILITY, OR AVAILABILITY OF THE APPLICATION
• UNINTERRUPTED OR ERROR-FREE OPERATION

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KAUF! AND ITS DEVELOPERS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
• DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE APPLICATION
• DAMAGES RESULTING FROM ANY CONDUCT OR CONTENT OF THIRD PARTIES
• DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO OR USE OF THE APPLICATION
• LOSS OF DATA DUE TO DEVICE FAILURE, LOSS, OR THEFT
• SYNCHRONIZATION ERRORS OR DATA CONFLICTS

8.3 Maximum Liability

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE ACTION GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify, defend, and hold harmless Kauf!, its developers, affiliates, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of or access to the Application
• Your violation of these Terms of Use
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right
• Any claim that your use of the Application caused damage to a third party
• Content you create, share, or transmit through the Application

10. Third-Party Services

10.1 App Store Services

• The Application uses app store services (Apple App Store, Google Play Store) for distribution and in-app purchases
• Your use of these services is subject to the app store's Terms and Conditions
• The app store is not responsible for the Application or its content
• The app store may be a third-party beneficiary of this Agreement

10.2 Third-Party Beneficiary

You and Kauf! acknowledge and agree that the app store (Apple, Google, or their subsidiaries) are third-party beneficiaries of these Terms of Use. Upon your acceptance of these terms, the app store will have the right (and will be deemed to have accepted the right) to enforce these Terms of Use against you as a third-party beneficiary.

11. Changes to Terms

11.1 Modification Rights

We reserve the right to modify these Terms of Use at any time. We will notify you of any material changes by:

• Posting the new Terms of Use in the Application
• Updating the "Last Updated" date at the top of this document
• Providing notice through the Application or other reasonable means

11.2 Acceptance of Changes

• Your continued use of the Application after changes are posted constitutes acceptance of the new terms
• If you do not agree to the modified terms, you must stop using the Application and may delete it from your device

12. Termination

12.1 Termination by You

• You may stop using the Application at any time
• You may delete the Application from your device at any time
• You may delete your account and all associated data at any time
• Cancellation of your subscription does not automatically delete the Application or your data

12.2 Termination by Us

We may terminate or suspend your access to the Application immediately, without prior notice or liability, for any reason, including if you breach these Terms of Use.

12.3 Effect of Termination

Upon termination:

• Your right to use the Application will immediately cease
• You may delete the Application from your device
• Your data may be deleted in accordance with our Privacy Policy
• All provisions of these Terms of Use that by their nature should survive termination shall survive termination

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the jurisdiction in which the Application is used, without regard to its conflict of law provisions.

13.2 Dispute Resolution

• Any disputes arising out of or relating to these Terms of Use or the Application shall be resolved through good faith negotiations
• If a dispute cannot be resolved through negotiations, it shall be resolved through binding arbitration in accordance with applicable arbitration rules
• You waive any right to a jury trial in connection with any dispute

14. Severability

If any provision of these Terms of Use is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms of Use shall otherwise remain in full force and effect and enforceable.

15. Entire Agreement

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and Kauf! regarding the use of the Application and supersede all prior agreements and understandings.

16. Waiver

No waiver of any term of these Terms of Use shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms of Use shall not constitute a waiver of such right or provision.
